Terms & Conditions

These Terms & Conditions (“Terms”) are a binding agreement between you and Fynvestor Investment Advisory (Proprietor: Krishna Goyal) (operating the brand “RealCase”; “we”, “us” or “our”) governing your access to and use of realcase.in and the RealCase mobile application (the “Platform”). By accessing or using the Platform, you agree to these Terms and to our Privacy Policy and Editorial Policy. If you do not agree, please do not use the Platform.

1. What RealCase is (and is not)

RealCase is a technology platform that publishes model portfolios, research and market content authored by Fynvestor, a SEBI Registered Investment Adviser (Reg. no. INA000020563). RealCase is not a stock broker or portfolio manager. We do not execute trades, and we do not take custody of your funds or securities. You invest through your own broker and demat account and retain full control of your money at all times.

2. No guaranteed returns; market risk

Investments in securities markets are subject to market risks. Read all related documents carefully before investing. Model portfolios, research and any content on the Platform are for information purposes and are general in nature; unless you have entered into a separate written advisory agreement, nothing on the Platform constitutes investment advice tailored to your individual circumstances. Past performance, including illustrative or model track records, is not indicative of future results. Registration granted by SEBI, membership of BASL and certification from NISM in no way guarantee the performance of the intermediary or provide any assurance of returns.

3. Eligibility

You must be at least 18 years old, a resident of India, and competent to contract under the Indian Contract Act, 1872, to use the Platform.

4. Your account

You agree to provide accurate, current and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorised use.

5. Subscriptions, fees and payments

Paid subscriptions are not yet available. RealCase is currently free to browse and to join the waitlist. The terms in this section and in the Refund & Cancellation Policy below take effect once we go live with the product.

• Access to paid features will require a subscription at the fees stated at the point of purchase.
• Fees are quoted in Indian Rupees (INR) and are exclusive of applicable taxes (including GST) unless stated otherwise.
• Payments are processed by our payment gateway, Razorpay; your payment is also subject to Razorpay’s terms.
• Where a plan renews automatically, we will disclose this at purchase, and you may cancel renewal as described below.

6. Refund & Cancellation Policy

You may cancel your subscription at any time from your account or by contacting us at contact@realcase.in. On cancellation, your access continues until the end of the current billing period, and the plan does not renew thereafter.

Because subscriptions provide immediate access to digital research and advisory content, fees are generally non-refundable except: (a) where required by applicable law; (b) in the case of a duplicate or erroneous charge; or (c) as expressly stated for a specific plan or promotion. Approved refunds are processed to the original payment method via Razorpay, ordinarily within 5–7 business days of approval. To request a refund, email contact@realcase.in with your registration details and reason.

7. Acceptable use

You agree not to:

• copy, resell, redistribute or publicly share paid research, model holdings or weights;
• scrape, reverse-engineer, or attempt to gain unauthorised access to the Platform;
• use the Platform for any unlawful, fraudulent or abusive purpose; or
• interfere with the Platform’s security or operation.

8. Intellectual property

The Platform and its content, including research, text, design, logos and software, are owned by us or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable licence to use the Platform for your personal, non-commercial use in accordance with these Terms.

9. Third-party services

The Platform relies on and links to third-party services (including Razorpay and your broker). We are not responsible for third-party services, and your use of them is subject to their own terms.

10. Disclaimers and limitation of liability

The Platform is provided on an “as is” and “as available” basis without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential losses, or for investment losses arising from your decisions. Our aggregate liability arising out of or relating to the Platform shall not exceed the subscription fees paid by you to us in the twelve (12) months preceding the claim.

11. Indemnity

You agree to indemnify and hold us harmless from claims and liabilities arising out of your breach of these Terms or your misuse of the Platform.

12. Suspension and termination

We may suspend or terminate your access for breach of these Terms or as required by law. You may stop using the Platform at any time.

13. Grievance redressal

For any complaint or concern, please contact our Grievance Officer at contact@realcase.in. We aim to acknowledge and resolve grievances promptly. See our Contact page for details.

14. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to applicable law and any regulatory dispute- resolution mechanism, the courts at Gurugram, Haryana, India shall have exclusive jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the current version, and your continued use of the Platform constitutes acceptance of the revised Terms.
